At Kizoa, we take your privacy very seriously. This privacy policy (titled “Privacy Policy”) has been developed in line with our Terms of Use and Terms of Service to inform you about how we collect, store, and use your personal Information.

By accessing and using the Kizoa website, mobile app and/or Kizoa services, you acknowledge and agree to be bound by this Privacy Policy. If you do not agree to any of the provisions that are set by this Privacy Policy further detailed below, you waive your right to use the Kizoa website, app or any other Kizoa services.

This Privacy Policy must be read and agreed to along with the Terms of Use and Terms of Service before using the Kizoa website, mobile app or Kizoa services. Together they constitute the entire agreement between you, the user, and Kizoa.

This Privacy Policy applies to any and all personal information that we collect online through using our website, mobile app and/or any of our services, including but not limited to email communication.

Kizoa reserves the right to change this Privacy Policy at any time without notice. We therefore ask you to review this policy periodically in order to be fully informed about how we collect, store, and use your personal information. You agree to this policy upon your first use of the Kizoa website, mobile app and/or Kizoa services and will continue to be bound to these terms even after you have ceased to use the website, mobile app and/or services.

Information That We Collect

The personal Information we collect from our users helps us personalize and improve the Kizoa website, mobile app and services. Listed below are the types of information that Kizoa collects:

Information Provided by You.

During your use of the Kizoa website and/or mobile app, Kizoa collects personal information provided by you either as part of your registration to the website or by any other means, including but not limited to providing your name, email address, and personal address. This personal information may be updated by you at any time. By using our website, our mobile app and/or services, you may supply us with other information supplied by your uploaded content and metadata such as the source of that content.

Automatic Information (Cache and Cookie data). When using the Kizoa website and/or the Kizoa mobile app, we collect personal information that your browser sends to every website you visit automatically, including but not limited to, your IP address, your browser information (including browser type, capabilities and language), your operating system, the date and time you accessed the website, and the website from which you accessed Kizoa. In addition, we may collect other information from you (such as location-based data). To organize this data, we may group some or all this personal information into aggregate data to describe the Kizoa website, mobile app and/or Kizoa services to potential business partners and advertisers, or in response to a legal demand. We may also group demographic information that we collect from our users into aggregate data for the same purposes. Upon demand by legal authorities, we reserve the right to use and share any non-personal information with third parties, including but not limited to lawyers and judges. We may associate your personal information with non-personal information within our database. In this case, we treat all the associated information as personal information as defined by this Privacy Policy. Except in the cases noted below, we do not share this associated personal Information with third parties.

How we use your information

Internal Use. We use personal information for internal purposes only, to improve the Kizoa website, mobile app and/or services for you as the user. In addition, we use the personal information collected to analyze who is using our website or mobile app and to deliver information to you about certain promotions, services or items that might interest you as the user. We may use your email address to contact you with news regarding the Kizoa website, mobile app and/or services.

Editing Information. You may review and edit any of your personal information by using your e-mail address and password. If you cancel your account, your personal information will be deleted from our database except for certain residual information within our databases which includes but is not limited to access logs, backup logs and other records, which may or may not contain personally identifiable information.

Troubleshooting. We may use your personal information and other data obtained from your current and past activities, in order to troubleshoot technical problems or resolve any disputes.

Kizoa will not sell, trade or rent your Personal Information to others unless you explicitly provide us with written permission to do so.

Disclosure of Personal Information

At Your Request. We will not disclose, sell or transfer any of your Personal Information to any third parties, except if you provide a written request as part of Kizoa Services.

Legal Disclosures. In the event we are required to disclose personal information and other related information for legal purposes, including but not limited to subpoenas, or court orders, or if we must verify compliance with applicable laws, we will make such disclosure.

Sale of Business. In the event the ownership of all or a part of Kizoa were to change, your personal information and other related information pertinent to our operations will be transferred to, and licensed for use by, the new owner.

To Protect Kizoa Services. We may disclose your personal information and other related information in the event we reasonably believe such disclosure is necessary to protect the Kizoa website, Kizoa mobile app, Kizoa services, our rights reserved as the service and website provider, our property, or the rights of any third party.

Third Party Service Providers. We use third-party service providers to perform certain services on our behalf, including but not limited to delivering print orders made through Kizoa. We may provide your personal information to these third-party service providers if they demand this information in order for them perform their services. These third-party service providers are contractually restricted from using personal information for any other purpose and required to comply with all applicable laws with respect to the your personal information and other related information they receive. This is defined and detailed by their Privacy Policy and/or Terms of Use or Terms of Service.

Exceptional Cases. Kizoa reserves the right to disclose your personal information and other related information, when we have reason to believe that disclosing such information is necessary to identify, contact or bring legal action against someone who may be violating this Privacy Policy, and/or our Terms of Service and Terms of Use. Such action will also be taken if we believe someone may be causing injury to or interference with (either intentionally or unintentionally), the rights reserved to us as the website/mobile app/service provider, to our property, other users, or anyone else that could be harmed by such activities. You therefore authorize us to disclose any information about you to law enforcement or other legal officials if we, in our sole and absolute discretion, believe that such a disclosure is necessary.

Sharing of Information

Our Privacy Policy only addresses the use and disclosure of personal information we collect while using the Kizoa website and/or Kizoa services. We have no control over privacy policies of third parties and Kizoa users will be subject to the privacy customs and policies of these third parties as noted in the aforementioned section.

Protection of Information

Personal information collected about you is protected in several ways. If you create a Kizoa account, you can access your Personal Information which is protected by a password and unique user ID that you select upon creation of your account. That password is encrypted. We recommend that you do not disclose your password to anyone in order to protect your account information and content. In addition, your personal information resides on proprietary secured servers that only selected personnel and contracts have access to with an encrypted password.

Your personal information is guarded under industry standard security measures and it is not available for use by unauthorized parties. However, Kizoa cannot guarantee that the personal information submitted to, maintained on, or transmitted from our systems will be completely secure. Regulations that govern personal data protection

There are currently various documents covering data protection in place at the national, international, and European levels. The most important ones are the following:

Kizoa undertakes to abide by its obligations in accordance with the aforementioned regulations, particularly the General Data Protection Regulations (GDPR). It’s this commitment to compliance in particular which means that Kizoa’s customers can also meet some of their own regulatory obligations. We strongly advise all our customers to be particularly vigilant on these aspects of compliance. Other, more specific regulations may exist, including for certain specific categories of personal data. In such cases, organizations are solely responsible for correctly identifying the regulations applicable to their business activities and achieving compliance with them. Choosing the right provider, especially when it comes to the cloud, is essential if you want to meet your own obligations on protecting personal data.

Kizoa’s Data Protection Officer (DPO): oversees data protection strategy and implementation to ensure compliance with GDPR.

Kizoa has appointed a DPO, whose role and aims are partly determined by European regulations. The DPO acts as a fully independent internal watchdog, ensuring that Kizoa’s data processing operations are compliant with all applicable European regulations.

Francois Aichelbaum is totally committed to his objectives and has the resources at his disposal to operate completely independently, without any conflicts of interest. He regularly runs awareness and training sessions for Kizoa’s employees and is there to answer their questions on privacy and data protection. He is in charge of implementing a “privacy by design” and “privacy by default” approach, especially for designing new solutions for customers, he liaises with supervisory authorities and more... He is also the first point of contact for any customers who need guarantees for the measures they have implemented in order to conform with applicable regulations, including the GDPR.

Cookies

You acknowledge and agree that we may use cookies on the Kizoa website and mobile app. A cookie is a piece of text that is stored into the memory of your hard drive and can store information about your use of the Kizoa website or mobile app (these are called "Cookies"). Cookies will help us make our services more convenient, personalized and more secure. In addition, Cookies allow us to keep track and retrieve information about any user who violates our Privacy Policy. We may also work with third parties who use Cookies and other system services to aid in their presentation of directed advertising and reporting of aggregate site usage statistics for the Kizoa website, Kizoa mobile app and Kizoa services. These statistics are not linked to personally identifiable information. If you would rather not have Cookies on your computer, you can set your web browser (e.g. Internet Explorer, Safari, Google Chrome, etc…) to deny some but not all Cookies. You can also delete Cookies from your computer whenever you as the user deem fit by accessing the settings of your web browser.

Other Websites, Services and Communities

When using the Kizoa website, mobile app and/or services, you may be directed via hyperlinks or other means to third-party websites, services and online communities that are not affiliated with us. These websites, services and online communities may send their own cookies to visitors in order to collect data or solicit your personal information. The privacy policies of these websites, services and online communities may be very different from the Privacy Policy set forth in these pages. We are not responsible for the privacy practices of these other websites, services and online communities and Kizoa cannot guarantee the security of any of the personal information collected, used or shared there.

When using the export to YouTube the API Client uses YouTube API Services. Details about that can be found in the Terms of Use.

Policy Regarding Children

Kizoa is a COPPA compliant website. You must be 13 years old or older to use the Kizoa website and/or Kizoa services; we do not knowingly collect information from children under the age of 13. If we become aware that we have collected Personal Information from a child under the age of 13 years old, we will delete such information from our database in order to adhere to COPPA regulations. If you are between 13 and 17 years old, you agree that you received your parent or legal guardian's consent to use and access the Kizoa website, Kizoa mobile app and/or Kizoa services.
